UKG Boy dies in Hyderabad after being hit by Teacher for not doing homework.

A UKG Boy was hit on his head on 30th September, 2023 by his teacher with a slate for not doing homework in Krishnaveni Talent School in Viveknagar, Hyderabad. The boy was shifted to a private hospital and he died while undergoing treatment.
How can a UKG teacher be so inhuman? The teacher is obviously not qualified for her job since B.ED course on early childhood development specifically talks about non usage of any form of touch intended to hurt the child. Capital Punishment is banned by Central government but it is still practised without shame by schools all over Andhra.
Teachers have no right to touch the child to hurt. Teachers have to take the child to the principal and the principal has to decide the situation. The Principal too has no right to impose corporal punishment.
Unqualified teachers who do not understand early childhood development, frustrated teachers having joined teaching for just sake of no other job, weak personality teachers are all put into primary education. Primary education or early childhood development requires specially trained teachers but even in so called international schools, non B.ED teacher or non early childhood teachers are taken in to reduce cost of hiring specialized teachers. These unqualified teachers cause permanent damage to the child’s psyche.
Caste is an integral part of Andhra Pradesh Society and caste feeling spills over to all sectors including education. In such biased schools, teachers bring their caste and social status into the school too and display bias towards their caste children.
Parents have no choice except to force their children to accept the bias damaging their psyche so early in life. It really hurts when only a particular group gets preference in interschool competitions, events, etc., We advise parents to never join children in such schools but due to the obsession of sending to branded schools, the parents send their children. Many international schools come to Andhra with neutral bias, but the society of Andhra Pradesh soon makes caste an integral part of school since obviously local teachers are hired. Only a few schools have chosen to rise above caste making them visionary and creative schools.
Missionary Schools are the safest when it comes to caste bias. Since no bias is ever shown and hence despite emergence of several private schools, missionary schools still command a premium across India. Having studied in normal schools, casteist schools and missionary schools, i find them missionary schools far more neutral than casteist or normal schools.
In every such incident, a case is registered against the individual and it settles down. The school is never taken to task for harbouring corporal punishment. Incidents such as these would not have occurred if Government had acted on earlier such incidents and made stricter punishments against the institution rather than the individual. The teacher can induce corporal punishment only with the tacit approval of the principal in using it. So, the principal is equally culpable.
There have been many such earlier incidents. We have attempted to outline just a few of them, especially recollecting past complaints against the school in other areas too.
- On Teachers day in Sept.5, 2015, in Krishnaveni Talent School in Hyderabad Langer Area, a 11 year child, Tanish Yadav was brutally hit by his teacher, Sudheer. He lost consciousness and was consequently hospitalised. On September 2, the boy was hit by the same teacher. A case under Section 323 (voluntarily causing hurt) and Section 325 (voluntarily causing grievous hurt) of the Indian Penal Code has been registered.
- On Aug 24, 2018, Telugu teacher B Yashwant thrashed and slapped a class tenth girl for just not being able to recite a poem. After receiving repeated blows to her face, the girl collapsed. The incident happened at Krishnaveni Talent School in Chilukangar.
- In April 2018, a four year old child from Krishnaveni Talent School, Meerpet was brutally caned by the teacher, Swaroopa for not paying school fees. The Meerpet Police registered a case under Sections 324 (Voluntarily Causing Hurt) and 506 (Punishment for Criminal Intimidation) of the Indian Penal Code. The teacher was also booked under Section 75 (Punishment for Cruelty to Child) of the Juvenile Justice Act.
- In Aug 2018, in NRI Talent School at Jeedimetla, a five year old boy was thrashed by teacher for not looking at the board while teaching. The child had blood clots on his hands.
- In Nov 2017, in Sacred Heart School at Tarnaka, a Five year old UKG student received beatings on his back by teacher, Kumudini. A case has been registered under IPC Section 324 (Voluntarily causing hurt by dangerous weapons or means) and relevant sections of the Juvenile Justice Act.
- In Sept, 2017, a seven year child student studying class two of Nehru Childrens School at Karwan was beaten for failing to read what was written on the board. A case under section 341 (wrongful restraint) and 323 (inflicting injuries) including Juvenile Justice Act.
- A teacher in Sesame Tree School in Narsingi stuck tape on the mouth of a UKG student for talking too much in class. Narsingi Police registered a case under Section 82 of the Juvenile Justice (Care and Protection of Children) Act based on the complaint of the boy’s mother
Several sections protect the rights of the child & allow law to prosecute perpetrators but are seldom applied since most of these schools have political connections. For example, in this case, Krishnaveni Talent School is owned by TDP MLC Chigurupati Vara Prasad.
Summarizing a few taken from http://www.aptabloid.com/alldata.php?id=88:
- Article 19 of U.N. convention of rights of child 1989 declares that any form of discipline involving violence is unacceptable.
- IPC Section 83 states that any child who has not done any homework or not dressed in appropriate fashion should not incite corporal punishment in schools.
- Section 17 of RTE act imposes absolute bar on corporal punishment. It prohibits physical punishment& mental harassment of child.
- IPC Section 323 & Supreme Court prohibits teachers from practicing power on children for any reason since a frequently hit child will be more problematic than disciplined.ØSection 325 state that causing grievous hurt amounts to a crime.
- IPC Section 305 will punish teacher in case of Abetment of suicide committed by a child;
- IPC Section 326 causing hurt by weapons or other means
The child has the right to directly take the matter to the lawmakers if there is any deviation to the above. The school shouldn’t encourage such outdated disciplinary methods. National Commission for Protection of Child Rights (NCPCR) has already given guidelines to end corporal punishment in schools. The guidelines ask schools to refrain from all kinds of corporal punishment, mental harassment and even discrimination on the basis of caste, community and gender. NCPCR forces teachers to give written undertaking that they wouldn't discriminate, cause mental harassment or indulge in physical punishment.
